These Terms of Service govern your use of Flora Luxe's website and services. By placing an order, you agree to these terms.

1. Acceptance of Terms

By using floraluxe.com or placing an order, you confirm you are at least 18 years of age and have legal capacity to enter binding contracts.

2. Products & Services

Availability: All products subject to availability. We reserve the right to modify offerings.

Pricing: Prices in USD and subject to change. Confirmed prices are final.

Substitutions: Due to seasonal availability, we may substitute flowers of equal or greater value while maintaining design integrity.

Bespoke Orders: Custom designs require advance notice and approval before production.

3. Orders & Payment

• • Payment required at time of order
• • We accept Visa, Mastercard, Amex, Discover, PayPal, Apple Pay
• • Corporate net-30 terms available (subject to credit approval)
• • Order confirmations sent within 1 hour
• • You're responsible for accurate delivery information

4. Delivery

Areas: Manhattan and surrounding boroughs. Extended areas may incur additional fees.

Times: Same-day delivery for orders before 2pm EST. Standard delivery 24-48 hours.

Fee: $35 standard. Free delivery over $300.

Attempts: If recipient unavailable, we'll leave at safe location or with building reception per instructions.

Delays: Not liable for delays from weather, traffic, or circumstances beyond our control.

5. Cancellations & Refunds

• • Standard orders: Cancel up to 24 hours before delivery for full refund
• • Same-day orders: Cannot be cancelled once in production
• • Bespoke/Event orders: 50% deposit non-refundable; balance refundable 7+ days before event
• • Freshness guarantee: 7 days with proper care; contact within 48 hours for issues
• • Refunds processed in 5-7 business days

6. Freshness Guarantee

We guarantee 7-day freshness with proper care. Not covered:

• • Improper care or handling
• • Extreme temperatures (below 50°F or above 80°F)
• • Direct sunlight exposure
• • Mechanical damage
• • Natural bloom cycles

7. Intellectual Property

All content including images, designs, floral arrangements, and proprietary techniques are Flora Luxe property protected by copyright and trademark laws. Reproduction prohibited without written permission.

8. Limitation of Liability

Flora Luxe not liable for:

• • Indirect, incidental, or consequential damages
• • Loss of profits or business opportunities
• • Delivery delays beyond our control
• • Allergic reactions to flowers or pollen
• • Property damage from water or containers
• • Loss after successful delivery

Total liability shall not exceed order amount.

9. Governing Law

These terms governed by laws of New York State. Legal actions must be brought in New York County courts.
